INTRODUCTION

The Kenya National Building Code 2024 (NBC 2024) serves as a pivotal update to the nation's construction regulations. Established under the National Construction Authority Act as a key subsidiary law, it supersedes the outdated Local Government (Adoptive By-Laws) (Building) Order from 1968 and became fully operational on March 1, 2025.

The prior regulations were inadequate for contemporary needs, as they were limited to conventional materials and failed to incorporate modern technologies, global norms, or sustainability principles. In contrast, the NBC 2024 offers a holistic, nationwide structure that aligns with international standards, ensuring buildings prioritize safety, quality, efficiency, eco-friendliness, and respect for human rights within the industry.

This code acts as more than just rules—it's a blueprint for fostering a resilient and eco-conscious built environment. It equips the sector to tackle current issues while protecting the well-being of Kenyans.

This alert provides an outline of the code's core features, its focus on enhancing building safety and occupant protection, and its significance for Kenya's construction field.

PURPOSE AND SCOPE OF THE CODE

The code aims to deliver a mandatory safety and order system for construction activities, setting standards that developers, investors, and experts must follow to produce durable, compliant, and eco-sustainable developments.

It emphasizes public safety by requiring all new buildings to adhere to criteria that prevent hazards linked to poor-quality construction nationwide. The code applies to anyone involved in building projects, including those seeking development approvals, environmental assessments, compliance certifications, and other necessary permissions. Designs, oversight, and inspections must be handled by qualified, licensed specialists.

Its goals encompass:

Establishing up-to-date criteria for design, building, and upkeep.

Ensuring structural soundness and community protection.

Incorporating eco-sustainability and energy conservation.

Improving synergy between planning and building permissions.

Promoting uniformity across regions and minimizing bureaucratic redundancies.

By unifying regulations nationally, the code boosts reliability, openness, and trust among investors in Kenya's building industry.

LEGAL AND REGULATORY FRAMEWORK

Developed by the Cabinet Secretary for Public Works in partnership with the National Construction Authority (NCA) and officially published on March 1, 2024, as Legal Notice No. 47 of 2024 under the National Construction Authority Act, the NBC 2024 creates a contemporary, all-encompassing system for overseeing building design, construction, and maintenance. It merges planning, construction, and environmental duties uniformly across Kenya's 47 counties.

The code's objectives align with Kenya's 2010 Constitution, particularly Article 43(1)(b) on rights to suitable housing and sanitation, Article 46(1)(a) on quality goods and services, and Article 66 on state regulation of land for public welfare, including safety, health, and planning.

Rooted in the National Construction Authority Act, it authorizes the NCA, county administrations, and related bodies to enforce adherence via approvals, monitoring, and penalties.

KEY PROVISIONS OF THE NATIONAL BUILDING CODE 2024

Structural Design and Materials

The NBC sets stringent standards for structures and materials, drawing from global codes. Buildings must endure various loads like static, dynamic, earthquake, and wind forces, focusing on longevity, usability, and security.

All construction materials require testing, certification, and traceability per Kenya Bureau of Standards (KEBS) and relevant international guidelines. Highlights include:

Selecting structural setups tailored to local conditions and climate areas.

Required adherence to fire and earthquake resistance codes.

Regular testing, checks, and approvals during key building phases.

These measures aim to eliminate inferior work and protect people, assets, and investments.

Siting and Spatial Planning

The code integrates planning rules from the Physical and Land Use Planning Act, 2019. Projects must follow zoning, density, and boundary rules, providing enough room for entry, light, air flow, and emergency access.

Linking building approvals to land planning simplifies processes and fosters better collaboration between national and local entities.

It also requires:

Parking allocation of at least one spot per 100 square meters of total floor space.

Electric vehicle charging stations in no less than 5% of parking areas.

This promotes an inclusive, future-oriented strategy that weaves accessibility and green transport into city layouts.

Environmental Sustainability

Sustainability and climate adaptability are central to the NBC. It requires eco-friendly methods, such as:

Designs optimizing energy use and heat efficiency.

Systems for collecting rainwater and reusing wastewater.

Controls on noise, dust, and debris during work.

Adoption of renewables like solar power.

Alignment with the Environmental Management and Coordination Act (EMCA).

Detailed rules cover waste disposal, drainage, and septic setups. Projects are urged to seek certifications like LEED, BREEAM, or IFC EDGE, syncing Kenya's sector with worldwide environmental efforts.

Safety, Health, and Worker Protection

Aligning with the Occupational Safety and Health Act (2007) and ILO norms, the code strengthens worker and public safety. Obligations include:

Securing sites and restricting public entry.

Safety plans and provision of protective gear.

Handling on-site noise, vibrations, and eco-risks.

Keeping records of incidents and compliance.

These enhance employee well-being, cut accidents, and safeguard the public during projects.

Accessibility and Inclusivity

Per the Constitution and Persons with Disabilities Act (2003), public and commercial structures must feature accessibility elements like ramps, elevators, tactile guides, and modified restrooms.

For instance, multi-story buildings need at least one staircase with minimum dimensions for height and width, compliant with KS ISO 21542, including natural light, ventilation, and clear landings. Escalators require accompanying stairs, emergency exits, and firefighter access protected from fire and smoke.

Compliance, Inspection, and Enforcement

Projects must be overseen by registered professionals like architects, engineers, and supervisors. Pre-start requirements include county development permission, NEMA environmental assessment, and NCA compliance certificate.

Checks occur at multiple stages, with occupancy allowed only after full verification. The NCA and counties can halt work, impose fines, or order demolitions for breaches.

The code aligns with international standards like the International Building Code, Eurocodes, and ISO for quality and environment.

Disaster Risk Management

All project phases must follow disaster guidelines, with coordination among parties. Owners provide pre-build info to contractors, ensure foreign designs comply, and contractors manage works to minimize health and safety risks.

IMPLICATIONS FOR KENYA’S CONSTRUCTION INDUSTRY

The NBC 2024 will transform Kenya's built spaces by advancing safety, green practices, and oversight. Effects include:

Clearer, consistent national rules.

Fewer unsafe or non-compliant buildings.

Greater trust from investors and financiers.

Embedding ESG factors in building.

Initial costs balanced by lasting economic, eco, and social gains.

It establishes Kenya as an attractive, accountable hub for infrastructure and property growth.

STRATEGIC CONSIDERATIONS FOR DEVELOPERS, INVESTORS, AND PROFESSIONALS

Perform audits to spot design and document shortfalls.

Revise contracts (e.g., FIDIC, JBC, EPC) to include NBC duties and risk allocation.

Add energy-saving and sustainable features to secure green funding and ESG appeal.

Educate teams and advisors on NBC rules, inspection processes, and reporting.

Keep thorough records of permissions, checks, and certifications for insurance and regs.

Involve expert legal and technical support early to ensure adherence and dodge penalties.

ROLE OF LEGAL COUNSEL

The NBC intersects with planning, eco, safety, and contract laws, demanding integrated advice.

Legal experts can offer full support across project stages—from ideation and funding to execution and disputes—covering finance, PPPs, construction regs, eco compliance, and ESG.

CONCLUSION

The National Building Code 2024 marks a significant advancement in regulating Kenya's built environment. By prioritizing safety, sustainability, and inclusivity, it harmonizes national aims with global standards.

For construction, infrastructure, and real estate players, following the code is essential for compliance and a chance to contribute to a robust, secure, and green Kenya.
