Power of Mercy Advisory Committee (POMAC)

The Power of Mercy Advisory Committee (POMAC) is a constitutional body in Kenya, established under Article 133(2) of the Constitution of Kenya, 2010, and operationalized by the Power of Mercy Act, 2011. Its primary mandate is to advise the President on exercising the power of mercy, a prerogative that allows the President to grant reprieves to convicted offenders. This includes issuing free or conditional pardons, postponing punishments, or remitting parts of sentences. POMAC ensures this process remains transparent, just, and free from bias, serving the public good.

The Committee collaborates with key stakeholders such as the Kenya Prisons Service, Judiciary, Probation and Aftercare Services, and the National Intelligence Service to facilitate informed decision-making. It engages county governments and non-state actors like religious and community-based organizations to support offender rehabilitation, resettlement, and reintegration. POMAC also involves victims by allowing them to submit impact statements during the petition process.

To enhance accessibility and efficiency, POMAC launched the electronic Petitions Management Information System (ePMIS) in 2022, enabling online petition submissions and status tracking. The Committee operates from its offices in Nairobi and comprises members with expertise in law, corrections, and human rights, ensuring a balanced approach to its functions. Through its work, POMAC plays a critical role in Kenya’s justice system, balancing mercy with public safety while promoting offender reform and societal reintegration.
